Road
Accidents
Section 143 of the Road Traffic Act 1988 provides;
1.
(a) a person must not use a motor vehicle on a road
unless there is in force in relation to the use of
the vehicle by that person such a policy of insurance
or such a security in respect of third party risks
as complies with the requirements of this Part of
the Act; and
(b) a person must not cause or permit any other person
to use a motor vehicle on a road unless there is in
force in relation to the use of the vehicle by that
other person such a policy of insurance or such a
security in respect of third party risks as complies
with the requirements of this Part of the Act.
The Act then goes on to specify the minimum requirements
for insurance cover and amongst other things the duty
to give insurance information when involved in an
accident.
Therefore
it is compulsory for drivers to be insured thus allowing
redress for innocent third parties who have been hurt
through their negligent driving.
Sadly,
there are far too many drivers in the UK who do not
have valid insurance or who fail to stop at the scene
of an accident they have caused.
In
such cases The Motor Insurers' Bureau (MIB), which
is a body funded by the motor insurance industry,
offers a scheme to pay compensation to innocent victims.
There
are however stringent rules and time frames involved
and specialist advice is preferable to avoid disappointment.
At
Fox Claims we have lawyers who specialize in MIB claims
and who would be able to assist with such claims.
